Supreme Court’s Decision in Scialabba v. Cuellar de Osorio – This is an alert from the office regarding the recent decision from the U.S. Supreme Court regarding the retention requirements under the Child Status Protection Act (CSPA) which were to allow the retention of the parent’s priority date when the child is not CSPA protected, and the parent files a new petition seeking a retention of the parent’s priority date for the child.
