Ramification of the U.S. Supreme Court Decision in Scialabba v. Cuellar de Osorio

As previously mentioned in our recent email alert, I was surprised and saddened by the U.S. Supreme Court decision in Scialabba v. Cuellar de Osorio, 2014 WL 2560467 (June 9, 2014). In a 5-4 decision, the U.S. Supreme Court reversed the 9th Circuit Court of Appeals’ decision in Cuellar de Osorio v. Mayorkas and agreeing with the Board of Immigration Appeal (BIA) in Matter of Wang, 25 I. & N. Dec. 28 (BIA 2009) that the Child Status Protection Act (CSPA) retention requirement does not apply to all derivative beneficiaries. Supreme Court’s Decision in Scialabba v. Cuellar de Osorio

This is an alert from the office regarding the recent decision from the U.S. Supreme Court regarding the retention requirements under the Child Status Protection Act (CSPA) which were to allow the retention of the parent’s priority date when the child is not CSPA protected, and the parent files a new petition seeking a retention of the parent’s priority date for the child.

Thông tin cập nhật từ văn phòng về quyết định từ Tối Cao Pháp Viện Hoa Kỳ về việc xin lại ngày ưu tiên của hồ sơ trước đây dưới luật bảo vệ trẻ em theo diện CSPA, xin cho phép người con không được luật CSPA bảo vệ đi theo hồ sơ cha mẹ, được xin lại ngày ưu tiên của hồ sơ cha mẹ trước đây, khi cha mẹ làm hồ sơ bảo lãnh lại cho người con.

La Decision de la Corte Suprema en Scialabba v. Cuellar de Osorio

Esta es una alerta de la oficina con respecto a la reciente decisión de la Corte Suprema de los EE.UU. en relación con los requisitos de conservación establecidos en la Child Status Protection Act (CSPA) que iban a permitir la retención de la fecha de prioridad de los padres cuando el niño no es CSPA protegido, y el padre presenta una nueva petición que buscan una retención de la fecha de prioridad de los padres para el niño.

Visa Regression and DS-260 Immigrant Visa Application

As expected for the June 2014 visa bulletin, the priority date for F2A preference (green card holder petitioning for spouse or unmarried child under 21 years of age) will regress to May 1, 2012. F2A will continue to regress for the remaining current fiscal year, and F2A for Mexican nationals could become unavailable until next fiscal year. On the positive end, F2B preference (green card holder petitioning for unmarried child over 21 years of age) continue to progress and has surpassed the F1 preference for unmarried child and over 21 years of age for U.S. citizen parents. At a liaison meeting with the American Immigration Lawyers Association (AILA), Mr. Charles Oppenheimer with the Department of State, advised that the F2B progression will continue much like the F2A did the past year, and this progression will only be temporary and would return to its slower pace. For this reason, we still encourage our clients to always try to become a naturalized citizen because there are other federal benefits which come with being a United States citizen.
