Here we go… executive actions!
The 2014 mid-term election is over. The Senate and the House of Representatives are now in the majority rule of the Republican Party. The vast majority of states are now governed by the Republican governors. For over a decade, attempts have been made to reform our antiquated immigration system, and there has not been any success. With the two years left for the remaining presidency’s term, it looks like there is not any hope for immigration reform from the Republican Congress.

Foreign Criminal Convictions
When the U.S. Department of State realized that the Vietnamese government could provide a more detailed police clearance (Ly Lich Tu Phap So 2), it started requesting intending immigrants from Vietnam to provide the new police clearance. Effective November 2012, all Vietnamese immigrant visa applicants who will be processed through the U.S. Consulate in Saigon, or other consulates, are now required to submit the Police Clearance Letter #2. The major difference between the previous police clearance letter and the current letter is that the Vietnamese government will provide all incidents of arrest, regardless if the previous arrest lead to a conviction or an expungement of the conviction.

Kết tội hình sự tại nước ngoài
Khi Bộ Ngoại Giao Hoa Kỳ nhận ra rằng chính quyền Việt Nam có thể cung cấp Lý Lịch Tư Pháp với nhiều chi tiết, Bộ Ngoại Giao đã yêu cầu người Việt Nam có ý định định cư phải nộp bản Lý Lịch Tư Pháp Số 2 mới này. Có hiệu lực từ tháng 11 năm 2012, tất cả người Việt xin Visa định cư giải quyết thông qua Lãnh Sự Quán Hoa Kỳ tại Saigon, hoặc tại các Lãnh Sự Quán khác, phải nộp Lý Lịch Tư Pháp Số 2. Sự khác biệt chính giữa 2 bản Lý Lịch Tư Pháp là chính quyền Việt Nam sẽ liệt kê tất cả các lần bắt giữ, cho dù việc bắt giữ có đưa đến buộc tội hoặc bản án được hủy bỏ.

Admission process at IAH
