Immigration Reform
2013 will be a very busy year in immigration law. Already, USCIS has announced on January 3, 2013 that the provisional waiver will begin on March 4, 2013. There are plans for immigration reform from the President and prominent Senate leaders. According to the Los Angeles Times, President Obama will mention immigration reform as part of his inaugural speech and will push for immigration reform as a focus of his second term in office. Several prominent Senate leaders have already met to discuss how to proceed with immigration reform, and the Wall Street Journal today reported that Florida Republican Senator Marco Rubio already has his own proposal for immigration reform and plan to introduce in Congress.

Bộ trưởng Napolitano thông báo quy tắc cuối cùng của thủ tục xin ân xá
Bộ trưởng An ninh Quốc Phòng Janet Napolitano ngày hôm nay đã công bố bài viết của một quy tắc cuối cùng trong Federal Register làm giảm thời gian công dân Hoa Kỳ ly thân từ thân nhân của họ (vợ, chồng, con cái hay cha mẹ). Những người đang trong quá trình này sẽ được cấp thị thực để trở thành thường trú nhân hợp pháp ở Hoa Kỳ trong những hoàn cảnh nhất định. Quy tắc cuối cùng này thiết lập một quá trình mà cho phép một số cá nhân nộp đơn xin ân xá sự hiện diện tạm thời trái pháp luật trước khi họ rời Hoa Kỳ để tham dự các cuộc phỏng vấn xin visa nhập cư ở các quốc gia xuất xứ của mình. Quá trình này sẽ có hiệu lực vào ngày 04 tháng 3 năm 2013 và các thông tin nộp đơn sẽ được cung cấp trong vài tuần tới tại www.uscis.gov

Secretary Napolitano Announces Final Rule to Support Family Unity During Waiver Process
Secretary of Homeland Security Janet Napolitano today announced the posting of a final rule in the Federal Register that reduces the time U.S. citizens are separated from their immediate relatives (spouse, children and parents), who are in the process of obtaining visas to become lawful permanent residents of the United States under certain circumstances. The final rule establishes a process that allows certain individuals to apply for a provisional unlawful presence waiver before they depart the United States to attend immigrant visa interviews in their countries of origin. The process will be effective on March 4, 2013 and more information about the filing process will be made available in the coming weeks at www.uscis.gov.

Secretaria Napolitano Anuncia Regla Final para Fomentar la Unidad Familiar Durante el Proceso de Exención Provisional
La Secretaria del Departamento de Seguridad Nacional, (DHS, por sus siglas en inglés), Janet Napolitano, anunció hoy la publicación de una regla final en el Registro Federal que, en ciertas circunstancias, reduce el tiempo que los ciudadanos permanecen separados de sus familiares inmediatos (cónyuges, hijos y padres) cuando están en el proceso de obtener visas para convertirse en residentes permanentes legales de los Estados Unidos. La regla final establece un proceso que permite a ciertos individuos solicitar una exención provisional por presencia ilegal antes de salir de los Estados Unidos para presentarse a las entrevistas de visa de inmigrante en sus países de origen. El proceso estará en efecto el 4 de marzo de 2013, y más información sobre cómo solicitar estará disponible en las próximas semanas en www.uscis.gov/espanol.
