Đã hơn một thập kỷ cải cách di trú chưa được thông qua. Quốc hội tạm nghỉ mùa hè mà không thông qua dự luật ngân sách yêu cầu từ Tổng Thống để hỗ trợ số lượng lớn trẻ em Trung Mỹ nhập cảnh vào Hoa Kỳ. Thống Đốc Rick Perry đã kêu gọi khoảng 1000 lính quốc gia để bảo vệ biên giới phía Nam Texas. Border Patrol và các cơ quan thực thi luật nhập cư đang bị choáng ngợp với nhiệm vụ trong khi nguồn lực hạn chế để lưu trú cho những người nhập cư bị bắt giữ, đặc biệt là trẻ em. Điều tệ nhất là tòa án di trú, dù đã làm việc hết công suất, nay bị yêu cầu phải ưu tiên giải quyết trể em Trung Mỹ, trong khi trì hoãn điều trần những người nhập cư không giấy tờ cho đến nhiều năm sau. Executive Decision
It has been more than a decade and no comprehensive immigration reform has passed. Congress has adjourned for the summer without passing the President’s requested budget bill to aid with the influx of young Central American children entering the country. Governor Rick Perry has called up about 1,000 Texas national guards to protect the Texas southern border. The Border Patrol and immigration enforcement agencies are overwhelmed with its enforcement tasks and the limited resources in housing the detained immigrants, especially children. Worst, immigration courts, already overstretched, are now required to give priority to Central American children who were detained while postponing other undocumented immigrants’ hearings years into the future. Sadly, there is no end in sight as the influx of the Central American children and other undocumented immigrants will continue as the violence and desperation in their home countries persist.

Trẻ em Trung Mỹ không người đi kèm

Unaccompanied Central American Children
Within the past few months, there has been a surge of unaccompanied Central American children from El Salvador, Honduras, and Guatemala seeking safe haven at the U.S. border in Texas and Arizona. The huge surge, estimated at about 57,000 minor children, will continue to increase to around 120,000 minor children by the end of the year. Driven by extreme violence, poverty, separation from family members, and desperation, there is no end in sight as more of these minor children will track the dangerous countries to find a safe haven and a better future in the United States. Once inside the United States, these minor children surrender themselves to the Border and Custom Protection Service to be processed for removal proceedings before an immigration judge. For those minor children from Mexico, they will undergo a credible fear interview and may be immediately returned to Mexico to the Mexican children social service authorities. However, for Central American children, they will undergo a long standing procedure of removal proceedings, and at the same time, they will be handed over to the Office of the Refugee Resettlement (ORR) for placement with family members or sponsors.

Phân tích quyết định của Tối Cao Pháp Viện trong Scialabba v. Cuellar de Osorio
